Welcome to NanoETH. These Terms of Service ("Terms," "Terms of Service") govern your relationship with the https://nanoeth.com website (the "Service") operated by NanoETH Inc. ("us," "we," or "our"). NanoETH is a blockchain node hosting, staking, and monitoring platform. By accessing or using the Service, or clicking a button or checking a box marked "I Agree," you indicate that you have read, understood, and agree to be bound by these Terms of Service, and to the collection and use of your information as outlined in the NanoETH Privacy Policy. These Terms apply to all visitors, users, and others who register for or otherwise access or use the Service ("You", “User”, “Users”). Certain services may be subject to additional terms and conditions specified by us, and your use of such services is subject to those additional terms and conditions. By accessing or using the Service, you agree to be bound by these Terms and accept all legal consequences.
NanoETH is not a cryptocurrency exchange. We do not endorse or recommend any particular digital asset, transaction, or purchasing strategy. No content on the NanoETH website nor communications with company personnel constitutes purchase or investment advice. Independent advice should be sought where appropriate. You acknowledge and agree that all transaction decisions are made solely by you, and NanoETH bears no responsibility or liability for the outcome of your decisions. Please read this agreement carefully to ensure that you understand each provision before using the Service. If you do not agree with these terms of service, in whole or in part, please do not use the Service.
If you choose to register for the Service, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Service's registration form. Registration data and certain other information about you are governed by our Privacy Policy. If you are under 18 years of age, you are not authorized to use the Service, with or without registering. Any use or access to the Service by anyone under 18 is strictly prohibited and in violation of these Terms. You may use the Service only if you are in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations. The Service is not available to any Users previously removed from the Service by NanoETH.
You agree, at all times, to utilize the Services solely for the purposes for which they are intended and not for any illegal or fraudulent activity. You agree to be bound by the Service rules below.
You agree to not use the Service to perform any of the following: post infringing content; upload content you do not have rights to; distribute malware; engage in unsolicited advertising; post unlawful or objectionable content; interfere with the Service; violate laws; impersonate others; harvest data; conduct unauthorized commercial activities; promote illegal activity; attempt to access materials not intentionally provided; reverse engineer; resell or transfer your account; scrape content; or use automated systems to overload the Service; among others described in the original Terms text.
The Service allows you to host and monitor blockchain nodes, as well as stake your digital assets through the medium of the NanoETH platform. To access hosting, staking, or monitoring functionalities, you must register to create an account. You can create an account using your email or SEED. A SEED account is protected with a 24-character combination login key. If you decide to use a SEED account, you understand and agree that NanoETH will not be able to notify you of any changes or updates to the Service via email.
With the NanoETH account you will (i) select a digital asset; (ii) provide your wallet address; (iii) where applicable select a payment plan; (iv) provide information regarding your payment instruments; (v) represent and warrant to NanoETH that such information is true and that you are authorized to use the payment instrument; (vi) promptly update your account information with any changes that may occur.
NanoETH, at its discretion, may modify or update the Service, in whole or in part at any time. Subject to these Terms, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to access and use the Service for your personal use only and as permitted by the features of the Service.
Your NanoETH account gives you access to the Service and any other functionality that we may establish and maintain from time to time. If you open an account on behalf of an organization, you represent you have authority to bind that entity and agree to these Terms on the entity's behalf. You are solely responsible for activity on your account and for safeguarding your credentials. Notify us immediately of any breach at [email protected].
We take privacy seriously. By using the Service, you consent to our collection and use of personal data as outlined in our Privacy Policy. We minimize the data we collect, do not sell personal data, and use industry‑standard encryption in transit and at rest. You may request access, correction, export, or deletion of your personal data at any time by contacting [email protected]. Your information may be processed in the United States and other jurisdictions where we or our subprocessors operate, always under contractual safeguards.
The Service may contain links to third‑party websites or services that are not owned or controlled by NanoETH. We strive to link only to reputable resources; however, we are not responsible for and do not endorse any third‑party content, policies, or practices. If you believe a linked resource is unsafe or inappropriate, please notify us and we will review promptly.
The Service and its content are protected by intellectual property and other proprietary rights. Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable license to access and use the Service for lawful purposes. You may not copy, modify, distribute, or create derivative works except as expressly permitted by us or applicable law.
NanoETH, its successors, and its affiliates are the owners or licensees of the content on the Service. If you believe your copyrighted work has been used in a way that constitutes infringement, please contact [email protected] with details of your claim and we will respond quickly, including by removing or disabling access where appropriate.
Fees, billing cycles, and any prepaid terms are described at checkout and in your account. We aim for transparent pricing with no hidden charges. If we make a billing error, we will correct it and, where applicable, issue a prompt refund or account credit. Certain services may be non‑refundable as disclosed at purchase.
We may suspend or terminate access for reasons including security risks, non‑payment, or breach of these Terms. Except in urgent circumstances (e.g., fraud or security incidents), we will provide notice and an opportunity to cure. You may appeal a suspension by contacting support; we will review and respond promptly.
You are responsible for your interactions with other users. If a dispute arises, our support team can help facilitate resolution in good faith, but we are not obligated to intervene or arbitrate disputes between users.
We design NanoETH to be safe and reliable and we stand behind our work. If a third party brings a claim against you alleging that the Service, when used as permitted, infringes that party’s intellectual property rights, or arising from our gross negligence or willful misconduct, we will defend you and pay any final judgments or settlements (including reasonable legal fees) to the extent caused by us. You agree to indemnify NanoETH for claims arising from your misuse of the Service or breach of these Terms. Each party’s obligations are conditioned on prompt notice and reasonable cooperation.
We aim to provide a secure, highly available platform and use commercially reasonable efforts to maintain 99.9% monthly uptime for core services. If we fall short, we will work with you to make it right, which may include service credits or other remedies. However, except for the commitments expressly stated in these Terms, the Service is provided on an “AS IS” and “AS AVAILABLE” basis and we disclaim other warranties to the extent permitted by law.
We strive to make your experience low‑risk. If something goes wrong due to our breach of these Terms or our gross negligence, we will be responsible for your direct and reasonably foreseeable losses. To the fullest extent permitted by law, neither party is liable for incidental, consequential, special, or punitive damages. NanoETH’s total aggregate liability for all claims in a 12‑month period will not exceed the greater of (a) the amounts you paid to NanoETH for the Service in that period or (b) USD $5,000.
These Terms are governed by the laws of the State of California, without regard to conflict‑of‑laws principles. The state and federal courts located in Los Angeles, California will have exclusive jurisdiction, and both parties consent to personal jurisdiction and venue in those courts.
These Terms constitute the entire agreement between you and NanoETH regarding the Service and supersede prior agreements. If any provision is held unenforceable, the remaining provisions will remain in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices will be sent to the email associated with your account unless you opt out where permitted.
